Jaide makes trade mark searching and filing simpler, but a search result or an AI suggestion is not the same as advice from an attorney. This page explains the limits of what the platform provides.
1. No legal advice
The content on this site, the results of the free exact search and the output of our AI features are general information. They are provided to help you understand the trade mark process and are not legal advice on your particular situation.
Legal advice is only given once an attorney engagement exists, for example when Dolata & co. attorneys accept a paid instruction for a comprehensive search or a filing. Until then, do not rely on the platform as a substitute for advice from a qualified attorney.
2. Attorney–client relationship
Browsing the site, creating an account, running a free exact search or receiving AI suggestions does not make you a client of Dolata & co. attorneys. An attorney–client relationship arises only when the attorneys accept a paid instruction, which may be subject to a conflict check.
Information you submit before an instruction is accepted is handled under our privacy policy, but it is not protected by legal professional privilege until a mandate exists.
3. No guarantee of registration
Filing a trade mark application does not guarantee registration. Every application is examined by the Companies and Intellectual Property Commission (CIPC). An examiner may object on absolute or relative grounds, and third parties may oppose the application after it is advertised.
Registration typically takes 18 to 24 months from filing, and the timing and outcome are outside our control. A positive search result or a filing receipt is not confirmation that your mark is, or will become, registered.
4. AI-generated content
Jaide uses artificial intelligence to analyse brand names, logos and websites and to recommend trade mark classes and marks. AI output can be incomplete, out of date or simply wrong, and it may miss conflicts that an attorney would notice.
Treat AI suggestions as a starting point. Before any filing is submitted the selected classes and marks are reviewed by an attorney, and you remain responsible for confirming that the information you submit is correct.
5. Search results and third-party data
Search results are drawn from CIPC records and other third-party sources. Those records may be delayed, incomplete or contain errors, and recently filed applications may not yet appear.
- The free exact search returns exact matches only. It does not find similar spellings, phonetic equivalents, translations, logos or marks in related classes.
- The comprehensive search is reviewed by an attorney and looks more widely. It reduces the risk of a conflicting mark but cannot remove it, because unregistered rights, pending applications and later filings can still affect your mark.
6. Deadlines and renewals
Trade marks carry deadlines: responses to examiner objections, opposition periods and renewals every ten years. Missing one can cause an application or registration to lapse.
Until the tracking dashboard launches, you remain responsible for monitoring deadlines on your marks unless you have instructed an attorney in writing to do so. A completed filing does not by itself include deadline monitoring or renewal reminders.
7. Limitation of liability
To the extent permitted by South African law, we are not liable for any loss arising from reliance on platform content, free search results or AI output, or from errors or delays in third-party records. Our liability for a paid instruction is set out in the terms of service.
Nothing on this page limits the professional duties of the attorneys once a mandate exists, or any liability that cannot be excluded by law.
8. External links
The platform links to external sites, including CIPC. We do not control those sites and are not responsible for their content, availability or privacy practices. A link is not an endorsement.
9. Professional regulation
Attorney services on Jaide are provided by Dolata & co. attorneys. Its practitioners are admitted attorneys regulated by the Legal Practice Council under the Legal Practice Act 28 of 2014. [Legal Practice Council details, including the provincial office and any practice numbers to be listed.]
Complaints about the professional conduct of an attorney may be directed to the Legal Practice Council.
